I William Sizemore of the county of Baldwin, Planter, being of sound mind and memory, do make and publish this my last Will and Testament herby revoking and making void all former wills by me at anythime heretofore made, and as to such worldly estate as I may die possessed of, I dispose of the same as follows:
First, I direct that all my debts and furneral expenses be paid as soon after my decease as possible out of the first monies that shall come into the hands of my Executor from any portion of my Estate real or personal.
Then second: I will and devise unto my beloved wife Levitia Sizemore all my lands
lying on the
east and on the west sides of the Alabama River, my dwelling house or
houses together with the following slaves to wit: Eliza, Ben, Morris, Will, Scott, John, Rebecca,
Betty, Albert, Viney, Lewis, Cumber, Henry, Thomas, Aurelia, Wallace, Sip, Brazil, Gilbert,
Sally, Riner, Daniel and Frozine, together with all such increase as they may have from the
date of this my will, and also all my stock of cattle, sheep and hogs, one good wogon and eight
mules, two Bay Fillies, and all my household and kitchen furniture. The above of my real and
personal estate above described.
I devise and bequeath unto my beloved wife Levitia to be held by her to her sole and separate use for and during the term of her natural life and no longer and to be in lieu of her dower at common law, if she shall so elect and I futher give unto my said wife, one thousand bushels of corn and ten thousaand pounds of fodder, for the use of the plantation slaves and stock hereinbefore bequeathed.
Then third: I will and bequeath unto my beloved daughter Rosannah Sizemore the following slaves to wit: June aged sixteeen years, Clara, aged twelve years and Jack aged sixteen years.
Then fourth: I give and bequeath unto my son David M. Sizemore, one slave named Henderson, aged about eighteen years. And it is my will that the slaves above given unto my daughter Rosannah and my son David M. Sizemore shall be received and taken by them over and above the amount and portion of my Estate to which they may be entitled upon the distribution of my estate.
Then fifth: It is my will and desire and I do hereby rest in my Executor full power
and authority
to dispose of all my real estate in fee simple upon the death of my
wife Levitia the same being
the plantations and lands heretofore devised and bequeathed
to her for life and the moneys arising from such sale or sales together with all the slaves
and other property hereinbefore bequeathed to her for life, I desire shall be equally divided
between all my children share and share alike.
Then sixth: It is my will and desire that all my estate both real and personal not herein and hereby disposed of by this my will shall upon my decease, or as soon thereafter as is practicable be taken possession by my Executor and shall by him be equally divided among all my children share and share alike.
And lastly: I do hereby make and ordain my esteemed friend John D. Weatherford, Executor of this my last will and Testament. In witness whereof I have to this my will written on one sheet of paper set my hand and seal this eighth day of November in the year of our Lord one thousand eight hundred and fifty three.
